The
program was created in 1967. The commission, which acts as an appeals
and policy board, consists of three members appointed by the governor
for four-year terms.
FUNDING
The program receives $25 for petty misdemeanors, $50 for misdemeanors
and $100 - $500 for felonies, as well as 10% of inmate wages. A VOCA
compensation grant is received each year.
ELIGIBILITY
REQUIREMENTS
Law enforcement reporting period: 72 hours
Filing period: 18 months
Exceptions: Requirements may be waived for good cause
PROCEDURES
All claims are adjudicated by staff and applicants are notified of their
eligibility and benefits.
Appeals: Within 60 days of the administrative decision, an applicant
may request a de novo hearing before the commission members. If the
applicant is dissatisfied with the commission decision, a reconsideration
request may be made. Within 30 days of the commission decision, the
applicant also may file an appeal to the circuit court in which the
applicant resides. The sole ground of appeal is that the decision exceeded
the commission's authority.
BENEFITS
Maximum award: $10,000; up to $20,000 in medical expenses, but if other
expenses or losses are sought, medical expenses plus other expenses
cannot exceed $10,000.
