Created in 1986, the program operates as a division of the Idaho Industrial Commission. Along with paying crime victim compensation, the program serves as the designated payment source for sexual assault examinations performed in the state.

FUNDING
The program receives $25 per misdemeanor, $50 per felony, and $200 per count for any sex-offense conviction. The program receives an annual VOCA compensation grant.

ELIGIBILITY REQUIREMENTS
Law enforcement reporting period: 72 hours

Filing period: 1 year

Exceptions: Good-cause exception construed liberally, especially in cases involving minors, domestic violence, sexual assault or abuse

PROCEDURES
Case manager makes the initial determination of eligibility. If the claim is found eligible, notice is sent to the claimant and to providers, who are asked to send bills for evaluation and payment.

Appeals: Claimant has 20 days to petition the program director for reconsideration of any award or order or, alternatively, 45 days to request a hearing with the commissioners of the Industrial Commission. The claimant's final appeal is through a motion for reconsideration to the commission.

BENEFITS
Maximum award: $25,000

Compensable Costs (with limits)

  • Medical expenses
  • Mental health counseling: $2,500 for direct victims; $500 for each family member of homicide and sex assault victims (maximum of $1,500 per family). Additional benefits up to maximum of $25,000 available in extenuating circumstances, defined as when a victim is having difficulty performing the activities of daily living or major life functions.
  • Lost wages/support: $175 per week
  • Funeral and burial: $5,000
  • Replacement services
  • Travel: to obtain medical treatment
  • Attorney fees: not to exceed 5% of award
  • Emergency awards available
