Created
in 1981, the program operates as an administrative unit within the Department
of Public Safety.
FUNDING
From mandated court judgments, the program receives $68 for class A
and B felonies, $46 for class C and D felonies, and $10 per misdemeanor.
The program also shares with the Dept. of Public Safety a $7.50 fee
assessed on all offenses, including infractions or violations of municipal
and county ordinances (the split of this fee is based on a statutory
formula that can vary based on the previous year's balance of the fund).
The program also receives an annual VOCA grant.
ELIGIBILITY
REQUIREMENTS
Law enforcement reporting period: 48 hours
Filing period: 2 years
Exceptions: child victims have up to 2 years from their 18th birthday
within which to file
PROCEDURES
Working with program staff, the program manager makes a final review
and decision on each application.
Appeals: The applicant
has 30 days to ask for a hearing, which is held before an administrative
law judge. A further appeal may be taken before the Labor and Industrial
Commission. Finally, the applicant may appeal within the court system.
