Created in 1978, the Crime Victims Assistance Section has responsibility for compensation and for federal and state victim services grants. The program also operates the state's Sexual Assault Victim's Emergency Medical Response Fund.

FUNDING
The program receives 8.5% of offender-paid assessments imposed as follows: $105 for felonies, $65 for misdemeanors, $95 for drunk driving, and $35 for offenses punishable only by a fine. The program returns 50% of those collections to prosecutors maintaining comprehensive victim service programs. The program also receives 60% of punitive damages awarded in civil cases. The program receives a VOCA grant annually.

ELIGIBILITY REQUIREMENTS
Law enforcement reporting period: 72 hours

Filing period: 6 months, with good-cause waiver

Exceptions: For child victims, time periods begin at date of disclosure

PROCEDURES
All decisions of claims examiners are reviewed by the director or assistant director.

Appeals: Adult victims have up to 90 days from the original order to ask for reconsideration; child victims have up to three years or until they turn 21 years of age, whichever occurs later. The Department has 30 days to reconsider. Applicant has 60 days after that to file appeal to the Workers Compensation Board.

BENEFITS
Maximum award: $44,000

Compensable Costs (with limits)

  • Medical expenses: $20,000
  • Mental health counseling: $20,000 for direct victims and family in homicides; $10,000 for children who witness domestic violence; $1,000 for relatives of an Oregon resident wo is a victim of international terrorism; $500 for acquaintance or friend of deceased victim who discovers body; limited amount of family therapy in child sexual abuse cases
  • Lost wages/support: $400 per week up to $20,000 limit
  • Replacement services
  • Funerals: $5,000
  • Travel: mileage reimbursement for medical/- counseling treatment if over 60 miles round-trip, to maximum of $3,000
  • Rehabilitation: $4,000
  • Emergency: $1,000
